1. About This Notice

Live at Home Senior Care is registered with the Florida Agency for Health Care Administration (AHCA) as a Homemaker and Companion Services provider under Florida Administrative Code Rule 59A-8.025. We provide non-medical companionship and homemaker services to seniors and veterans in Pasco County, and Pinellas County, Florida.

As a Homemaker and Companion Services provider, our services are limited to non-medical support such as companionship, light housekeeping, meal preparation, and similar daily living assistance. Under our current registration, we do not provide hands-on personal care services such as bathing, dressing, grooming, or medication assistance, and we do not provide skilled nursing or medical care of any kind.

This notice explains how we collect, protect, and handle information about the clients and families we serve.

2. We Are Not a HIPAA Covered Entity

The Health Insurance Portability and Accountability Act (HIPAA) applies to specific organizations defined by federal law as "covered entities" — generally health plans, health care clearinghouses, and health care providers who transmit health information electronically in connection with certain billing transactions such as Medicare or Medicaid claims.

Live at Home Senior Care is a private-pay, non-medical Homemaker and Companion Services provider. We do not bill Medicare, Medicaid, or insurance companies electronically for medical services, and we do not meet the federal definition of a HIPAA covered entity. This notice is provided voluntarily to explain how we protect client information, even though federal HIPAA does not apply to our agency.

Important: If we ever expand our license type, enter into agreements with hospitals or healthcare providers that require HIPAA compliance, or otherwise become subject to HIPAA, this notice will be updated to reflect that change.

3. Florida State Requirements We Follow

While federal HIPAA does not apply to our agency, Florida state law does impose specific confidentiality requirements on Homemaker and Companion Services providers. Under Florida Administrative Code Rule 59A-8.025(8), our agency is required to maintain a confidential client record for every individual we serve.

We take this state requirement seriously and apply the following practices:

  • Client records are kept confidential and secured against unauthorized access
  • Information is shared only with caregivers and staff directly involved in a client's care
  • Records are retained and disposed of in accordance with Florida Administrative Code and AHCA requirements
  • Client information is made available to AHCA for inspection as required by law

4. Information We May Collect

In the course of providing companionship and homemaker services, we may collect the following information from you or your family member:

  • Name, address, and contact information
  • Emergency contact information
  • General information about daily living needs relevant to companionship and homemaker services
  • Preferences related to meals, activities, and routine
  • Veteran status, if applicable

We do not collect or maintain detailed medical records, diagnoses, or medication management information, as these fall outside the scope of services our registration permits us to provide.

5. How We Protect Client Information

  • Client information is shared only with caregivers and staff assigned to that client's care
  • We do not sell or share client information with third parties for marketing purposes
  • All staff are trained on the importance of client confidentiality as a condition of their role
  • Client records are stored securely and access is limited to authorized personnel

6. When We May Share Information

We may share client information only in the following circumstances:

  • With your written consent, to a specifically named party such as a family member or physician
  • In a genuine emergency, to protect the immediate safety of the client
  • When required by Florida law, a valid court order, or a lawful request from AHCA or another government authority

7. Your Rights

You may contact us at any time to:

  • Request a copy of the information we maintain about you or your loved one
  • Request a correction to inaccurate information
  • Ask questions about how your information is used or protected

8. Website Privacy

Information submitted through our website's contact and care request forms is transmitted using secure HTTPS encryption and stored in our customer relationship management system. We do not request detailed health or medical information through our website forms. 9. Changes to This Notice

We may update this notice as our services, registration, or applicable Florida regulations change. The effective date at the top of this page will reflect the most recent update. We encourage clients and families to review this notice periodically.
